Learned counsel for respondent No.2 makes a statement that the charge-sheet has been filed. Learned APP supports the statement made by learned counsel for respondent No.2.

In that view of the matter, the applicant should be relegated to avail alternate available remedy before the trial Court itself after filing of the charge-sheet. Hence, we make the following order :

ORDER

i) Criminal Application (APL) No.52 of 2015 is disposed of with liberty in favour of the applicant to apply for discharge or as the case may be before the trial Court in view of the filing of the charge-sheet.
