The applicants (father and son) are arrested in crime registered against them for the offences punishable under Sections 302, 201, 452 read with Section 34 of the Indian Penal Code.

The prosecution has come up with the case that deceased Gopal has made oral dying declaration before Narendra Kharode, Raghunath and Rahul Dongardive who have given such statement before the police. The record shows that the deceased died because of blow given by a stick.

Considering the nature of allegations and the facts on the record specially that the applicants are not involved in any crime earlier and the fact that charge-
2 ba54.16 sheet is filed and the non-applicant has not been able to show that the custody of the applicants is necessary for further investigation, in my view, the applicants are entitled for being released on bail.

Hence, the following order :
i) The applicants having been arrested in Crime No.122/2015 registered by the non-applicant be released on bail, on furnishing P.R. Bond of Rs.10,000/- each and two solvent sureties in the like amount for each of the applicant.
ii) The applicants shall regularly attend the dates of sessions trial unless exempted by the Sessions Court. If the applicants fail to attend any date without seeking exemption from the Sessions Court, this order shall stand recalled.
