DATE : 20/01/2023 The applicant had put forth following prayers :- "(a) Release the applicant on interim bail for 15 days in Crime No.387/2019 registered with Paratwada Police Station, for the offence punishable Under 302, 324, 143, 147, 148, 149 of I.P.C. read with Sec. 135 of the Maharashtra Police Act in peculiar facts and circumstances of the case and in the interest of justice.

(b) Grant ad-interim regular bail to the applicant till the disposal of main application in Crime No.387/2019 registered with Paratwada Police Station.

And be further pleased to pass such other order and grant such other relief as may deem fit and proper in the peculiar facts and circumstances of the case and in the interest of justice;

And for which act of kindness the applicant shall remain duty bound and ever pray."

Learned counsel for the applicant sbumits that there is no evidence against the applicant and that this is case of mistaken identity, however, learned APP has pointed out that the applicant had earlier filed application seeking bail before this Court bearing Criminal Application(BA)No.939/2022. It has been rejected. Thus, this Court has found prima facie material against the applicant. He is facing charge of double murder. The charge being serious, it will be highly risky to release applicant even for seven days.

In view of the above and for the reasons recorded in order dated 29/08/2022 in Criminal Application(BA)No.939/2022, the application is rejected.
