Heard Shri B.G. Kulkarni, learned Counsel for the petitioners, learned A.G.P. for respondent no.1, Shri Abhijit Deshpande, learned Counsel for respondent no.2 and Shri Arun Agrawal, learned Counsel for respondent no.3.
Orders of Hon'ble Supreme Court dated 23.03.2015 in SLP CC No. 4818/2015, are produced before the Court. It shows that the Hon'ble Supreme Court has granted respondent no.2 University time of 6 weeks to take suitable decision.
It is therefore, apparent that examination notification No. 32/2014, which is brought to our
Order 2603wp598.15 notice as a via-media worked out by the University after 03.04.2014, is presently not available. Shri Deshpande, learned Counsel appearing for respondent no.2 University submits that it has been already withdrawn/canceled.
In this situation, when the Hon'ble Supreme Court is considering the controversy, it is apparent that this Court cannot pass any orders in the matter. We therefore, dispose of the Writ Petition. However, liberty to petitioners to approach again in appropriate jurisdiction, if any grievance survives or arises after the orders of Hon'ble Supreme Court. No costs.
