The order of issuance of Non-Bailable Warrant (NBW) and issuance of proclamation against the petitioner for his nonappearance has been challenged in this writ petition. 2.

The contention of the learned counsel for the petitioner is that neither summons nor Bailable Warrant were issued prior to issuance of NBW. According to him, even NBW has not been served to the petitioner.

After hearing some time, learned counsel for the petitioner submits that he will appear before the trial Court and apply for cancellation of NBW. He seeks withdrawal of the petition with liberty to approach before the trial Court for cancellation of NBW. He further submits that the petitioner apprehends that till he approaches the trial Court he may be arrested, therefore, prayed for appropriate order. 4.

Permission is granted. The petition stands disposed of as withdrawn with liberty as prayed for.

The Police shall not arrest or shall not take any coercive action, in the present matter, against the petitioner for two weeks from today.
