Learned counsel for the appellant has filed pursis dated 2.2.2015 in which it is stated that as the appeal against order is not tenable under the provisions of Order XLIII Rule 1 of the Code of Civil Procedure, liberty is sought to withdraw the appeal for preferring appropriate proceedings. In view of aforesaid pursis, the appeal from order is permitted to be withdrawn with liberty to challenge the order impugned herein in appropriate proceedings. The points raised in the appeal are kept open.
