Parties have settled their grievances outside the Court and the terms of it, are recorded in the minutes of order placed on record and marked as "X" for identification. The contents are reproduced below : "3. During the pendency of the present writ petition, the petitioner and contesting respondent no.3 have arrived at the settlement as under and, therefore, both of them jointly pray to pass order as under :

(a) Cancellation of petitioner's tender by respondent no.3, Municipal Council vide impugned communication dated 17/01/2019 (AnnexureP16) may kindly be upheld. (b) The proceedings for forfeiting earnest money deposited by petitioner be quashed and set aside and the earnest money of Rs.10,41,877/- (Rs. Ten lacs forty one thousand eight hundred seventy seven only) deposited by petitioner be refunded by respondent no.3 Municipal Council to petitioner within a period of two weeks from the date of order of this Hon'ble Court."

wp.582.19 2/2 The learned Counsels for the parties submit that the aforesaid terms are binding upon all the parties and shall be acted upon. Hence, the petition stands disposed of in the aforesaid terms with no order as to costs.
