The explanation for delay in filing application under Section 378 (4) of Criminal Procedure Code is not entirely satisfactory, inasmuch as the delay post dismissal of the untenable appeal by the Sessions Judge is not properly explained. However, the application is allowed in the interest of justice, subject to costs of Rs. 5,000/- to be paid to the non-applicant.
