Heard.

Learned Counsel for the applicant has submitted that there is no evidence against the applicant/accused. Therefore, he is entitled for bail.

Learned APP has pointed out the case diary and submitted that there is sufficient material against the applicant/accused. Hence, the application is liable to be dismissed.

Perused the statement of Ajay Komti Naroti, resident of Nargunda, Bhamragarh. In his statement, he has stated that at the time of incident, the applicant was having one plastic bag and he was accompanying with other two persons. He was found near the spot of incident where pipe bomb was exploded. The police party was there. Fortunately, they did not sustain any injury. Report was lodged by one of the police officers. During the investigation, it was revealed that in the house of applicant, explosives were found. Those explosives were sent to Chemical Analyser. As per the CA report, the explosives seized from the house of accused were found to be explosive. From the statement of witness, it appears that the applicant was the active member for explosion

2 2702ba84.19 of the pipe bomb. Hence, he is not entitled for grant of bail. In the result, the application is rejected.
