Heard Shri B.M. Khan, learned Advocate for the petitioners, Shri P.V. Ghare, Advocate holding for Shri A.M. Ghare, learned Advocate for respondent No.2 and Shri A.D. Sonak, learned Assistant Government Pleader for respondent No.4.

The petitioners-employees being dissatisfied by the order passed by the Industrial Court granting them wages in lieu of notice and absolving the respondent No.1-earlier employer of its responsibility, have filed this petition. The points raised by the petitioners require consideration.

Rule.

Shri Ghare, learned Advocate waives notice for respondent No.3 and Shri Sonak, learned Assistant Government Pleader waives notice for respondent No.4.

Considering the facts of the case and nature of the claim of the employees, the order dismissing the petition against respondent No.1 is recalled. The petition against respondent No.1 is restored.

For the reasons stated in the application, the petitioners are permitted to serve respondent No.1 by publishing notice in the daily "LOKMAT" published at Nagpur. The civil application is disposed.
