DATE : 29-03-2023 The application is filed for condonation of delay. During the pendency of the application along with the appeal, both the parties have arrived at settlement and filed a joint compromise pursis. As per the settlement, both the parties agreed that respondent no.1 is entitled to receive Rs. 16,50,000/- together with accrued interest thereupon from the date of deposit of the said amount in this Court and remaining amount of Rs. 1,25,483/- is to be refunded to the appellant/Insurance Company along with accrued interest.

I have personally interacted with respondent no.1. She accepted the terms and conditions of the joint compromise pursis. In view of the settlement, application along with the appeal are disposed of.

Out of the compensation amount, amount of Rs.2 lakh each shall be deposited in the name of Ku. Nandni d/o Devidas Gedam and Sandip s/o Devidas Gedam i.e. respondent nos.2 and 3, till they attain the majority.

The respondent no.1 is at liberty to withdraw the rest of the amount along with the accrued interest. The amount be transmitted in the account of respondent no.1.
