IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR MISC. CIVIL APPLICATION NO. 296 OF 2015 IN WRIT PETITION NO. 1117 OF 1991 (Dada s/o Tukaram Zode vs. The MSEB thr. its Chairman P. Abraham & Ors.) Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.
CORAM : B.P. DHARMADHIKARI & S.B. SHUKRE, JJ.
APRIL 10, 2015.
Heard Shri Zode, Applicant-in-person. The contentions as raised are not sufficient to call for review.
Writ Petition No. 1117 of 1997 was filed by 10 persons and the present applicant is Petitioner No. 2 in that matter.
After hearing learned counsel for the petitioners as also the respondents in the writ petition and after considering the entire controversy, this Court in judgment dated 06.01.2015 found that the relaxation was made on two occasions and it was not in dispute. It was in case of 37 Degree holders and 65 Diploma holders on one occasion and thereafter in case of 87 Degree holders and 81 Diploma holders. While addressing us on review, the review applicant has not commented on this fact.
In view of other findings in our judgment, we have observed that it was not proper to intervene in the promotion order after six years. We have also, in
1004mca296.15 addition found that the promotions were effected on 25.02.1985 i.e. about 30 years back. The pendency of this matter before this Court for long time has, therefore, been mentioned only as an additional fact. No case is, therefore, made out for interference in review application. The same is accordingly rejected. No order as to costs.
