Heard the learned Advocate for the applicant/appellant and the learned Advocate for the respondent. Perused the judgment of the learned Trial Court as well as the learned Appellate Court. The learned Trial Court had convicted the respondent for the offences punishable under Section 138 of the Negotiable Instruments Act, 1881. In the appeal the respondent is acquitted by the learned Sessions Court since arguable points are raised in the appeal, it requires consideration. The application is therefore allowed by granting leave to file appeal. Registry to register the appeal as per rules.
