The matter is taken up for final disposal by consent of both learned Counsel appearing for the parties.

The petitioner has applied for availing benefit of Government Resolution dated 10.01.2006, which is a special remission scheme available for the convicts who have completed 65 years of age, weak and had undergone actual imprisonment for 14 years.

The State resisted the petition by filing a reply stating that the petitioner has not undergone actual imprisonment of 14 years as well as has not completed 65 years of age. It is submitted that the petitioner is about to complete 65 years of age within two months. 5.

Having regard to the above facts, the petition does not carry any merits since the petitioner not qualifying the requisite criteria.

In view of the above, the criminal writ petition stands rejected.

The petitioner is at liberty to apply afresh after qualifying the requisite criteria.
