By this writ petition, the petitioner seeks a direction to the respondent Nos.1 and 2 to conduct the election to the Board of Directors of the petitioner society in view of the old by-laws of the petitioner society. The petitioner seeks a direction that the amendment for constituting the Board of Directors with 20 members should be permitted.

It is stated that in an appeal filed by the Chairman of the Bhandara Central Co-operative Bank Limited before the State Government, the State Government had permitted 20 members on the Board of Directors of the said Bank. It is stated that if the State Government takes a similar view in respect of the petitioner/Gondia District Central Cooperative Bank Limited, the petitioner's grievance would stand redressed.

Bhoyar, the learned Assistant Government Pleader appearing on behalf of the respondents, on instructions, states that the petitioner Bank may file an appeal to the State Government, as was done by the Chairman of the Bhandara Central Co-operative Bank Limited, and an appropriate order would be passed in the said appeal.

Shri A.M. Ghare, the learned counsel for the petitioner states that the petitioner Bank would file an appeal before the State Government within a period of two weeks and the State Government may be directed to take appropriate decision on the same within a time frame. In view of the aforesaid, the petitioner may file an appeal before the State Government within a period of two weeks. If such an appeal is filed by the petitioner, the State Government should decide the same in accordance with law as early as possible and positively, within a period of six weeks from the date of the receipt of the same. The petition is disposed of in the aforesaid terms. No costs.
