The petitioners have challenged the order/communication dated 24.11.2023 passed by respondent No.1 3.

Learned counsel for the petitioners submitted that the order/communication was issued without giving notice to the petitioners, though they had specifically filed an application requesting the authorities to give notice to them before measurement.

I have perused the order and documents placed on record. It appears that prior to issuance of the communication dated 24.11.2023, no notice was issued to the petitioners. Even the communication itself does not indicate whether it was addressed to the petitioner. 5.

In view thereof, without going into the merits of

25 wp 576.24.odt..odt the matter, the communication/order dated 24.11.2023 is hereby quashed and set aside.

Respondent No.2 to issue notice to all the concerned and to proceed further in accordance with the law.
