Mr. P.R. Parsodkar, learned Advocate for petitioner, seeks leave to withdraw the Civil Application as the same is not being pressed.

Mr. Abhay Sambre, learned Advocate for respondent no.1 and Mr. N.H. Joshi, learned A.G.P. for respondent no. 2, point out that the only prayer in Writ Petition is to grant protection in employment in view of Full Bench judgment in the case of Arun s/o Vishwanath Sonone .vs. State of Maharashtra and others reported in 2015(I) Mh. L.J. 457. They submit that the said judgment has been overruled recently by Hon'ble Apex Court.

This development is not in dispute. As caste claim is already invalidated, it is apparent that the petitioner cannot claim protection in employment. Mr. P.R. Parsodkar, learned Advocate for petitioner, points out that the matter is already

10.7CAW.610.17 admitted for final hearing and it be listed for final hearing accordingly.

In view of judgment delivered by Apex Court, we find no substance in the request. Accordingly, rejecting the request, we dismiss the Writ Petition. No costs.
