DATE : 26.08.2015 The learned Counsel for the petitioner has tendered an affidavit in the Court today.
The same is accepted on record.
By this contempt petition, the petitioner has sought action against the respondents for wilful disobedience of the order dated 27.8.2007 in Writ Petition No.2724/2007. It is the case of the petitioner that though this Court had directed the respondents to promote the petitioner on the post of Stenographer (Grade -II) from the date on which roster point no.9 was filled up after his transfer in Maharashtra Circle, the order has not been complied with.
It is, however, stated on behalf of the respondents that the petitioner has been promoted on the post of
2608cp25.08.odt Stenographer (Grade-II) vide order dated 4.8.2015. It is stated that after the matter was decided by the Supreme Court, the order of promotion was issued.
Shri Dangre, the learned Counsel for the petitioner states that the petitioner has been promoted on the post of Stenographer but it is not from the date on which roster point no.9 was filled up. It is, however, stated in the affidavit tendered on behalf of the petitioner in the Court today that the petitioner would agitate the grievance in that regard by taking appropriate proceedings.
The contempt petition is disposed of as the petitioner stands promoted on the post of Stenographer (Grade-II). The petitioner would be free to take appropriate proceedings, if according to him, he is promoted from a subsequent date and not according when the roster point no.9 was filled up. No order as to costs.
