Heard Mr.S.N.Gaikwad, learned advocate for the applicant and Mr.M.D.Lakhey holding for Mr S.J.Kadoo, learned advocate for respondent No.1.
The learned advocate for the applicant submits that the proceedings which were pending before the Civil Court at Murtizapur are transferred to the Civil Court at Akola. He further states that an amendment application will have to be filed, however, the applicant is not responding. He seeks time to give intimation to the applicant for withdrawal of the Vakalatnama.
Be that as it may, accepting the submission made by the learned counsel for the applicant that the proceedings are transferred from Civil Court at Murtizapur to Civil Court at Akola, the present application has become infructuous. It is dismissed accordingly with liberty to the applicant to file fresh application, if so advised.
