DATE : 2.3.2016 Heard Shri R.J. Mirza, and Shri S.S. Shingane, advocates for the applicants in the respective applications and Shri M.J. Khan A.P.P. for the non-applicant.
The applicants are seeking pre-arrest bail apprehending arrest in crime registered against them for the offence punishable under Section 307, 323, 328, 143, 147 and 149 of the Indian Penal Code. The accusations against the applicants are that because of some dispute relating to relationship of Anjali w/o Suresh Rathod, with Kapil, Suresh was taken in a four wheeler and was administered poisonous material forcibly and then thrown near agricultural field of
2 aba3.16 Suresh (victim).
Considering the nature of allegations against the applicants, the fact that they are not involved in any crime earlier and as the non-applicant has not been able to show that custody of applicants is required for further investigation, in my view, the applicants are entitled for pre-arrest bail.
In the event of arrest of applicants in Crime No.297/2015 registered by the non-applicant, the applicants shall be released on bail on furnishing P.R. bond for Rs.20,000/- (Rs. Twenty Thousand Only) each and one solvent surety in the like amount for each of the applicant. The applications are allowed in the above terms. JUDGE Tambaskar.
