Heard Mr. Joshi, learned Adv., for the petitioner on the last date and today also.

Upon hearing and seeing the decisions cited by him at the bar today and on the last date, we are satisfied that we must follow the dictum of law laid down by the Three-Judge Bench of the Apex Court in the case of Dr. (Mrs.) Veena Kapoor Vs. Varinder Kumar Kapoor [ (1981) 3 SCC 92]. That being so, we make the following order:-

O R D E R

Criminal Writ Petition No. 90 of 2015 is disposed of by reserving liberty in favour of the petitioner

to take up the issue raised in the present petition in the pending proceedings before the Family Court or any other competent court, at the behest of the parties, and this Court expects that if such urgent application is moved, the Family Court will take up the matter on urgent basis.

Disposed of.
