This Court, on 03/02/2022 granted ad-interim anticipatory bail to the applicant in Crime No. 1416/2021, registered with the Police Station Rajapeth, Tq. and Dist. Amravati for the offences punishable under Section 304-B and 498-A read with Section 34 of the Indian Penal Code against the applicant and two other accused persons who are the husband and son of the applicant.

Learned counsel for the applicant submits that three months before the date of suicide, the deceased left the house of the applicant and on the date of alleged incident, she was staying with her parents. It is submitted that the applicant is falsely implicated in this crime. It is further submitted that the accused Nos. 1 and 3 they were already released on regular bail.

It is further submitted that the custody of the

Shri S.D.Sirpurkar, learned APP strongly opposed the application.

After going through the case diary and on perusal of the contents of the FIR, as prima facie no incriminating material is available against the applicant, I am of the opinion that ad-interim anticipatory bail granted to the applicant vide order dated 03/02/2022 needs to be confirmed. Accordingly, I pass the following order:- i] Criminal application is allowed.

ii] The order dated 03/02/2022 is confirmed with a modification that the applicant shall attend the concerned police station, whenever her presence is required.
