Para 4 and 5 of the affidavit dated 05.03.2025 sworn by the Chairman of respondent - Agricultural Produce Market Committee, Nagpur, read thus : "4. That, he answering respondents further submit that Respondent No.2 granted approval vide communication dated 26.09.l2024.

Subsequently, upon receiving this approval, appointment orders were issued to the concerned individuals, including the petitioners, on or about 15.02.2025. The answering respondents further submit that, concerning consequential service benefits and arrears of pay, the process is currently underway as per the order of approval dated 26.09.2024.

5. That, the answering respondents most humbly submit that, in light of the above facts, the grievance of the petitioners has been duly addressed. The petitioners have sought relief regarding the issuance of appointment orders for the regularization of their services in pursuance of the approval dated 26.09.2024 and the resolution dated 07.12.2024. Since the

2 955.wp.511.25 appointment orders have already been issued, the present petition has become infructuous and is liable to be dismissed."

Since it is conceded by the learned Counsel appearing for the respondent No.3 that the petitioners are already granted appointments, the only issue pertains to the extension of the monetary benefits to which they are entitled.

In view of what has been stated and reproduced hereinabove as reflected in the affidavit, it will be appropriate for us to dispose of the present Writ Petition by directing the respondent - Agricultural Produce Market Committee, Nagpur to release the benefits in favour of the petitioners and similarly placed persons to which they are lawfully entitled within a period of four weeks from today. 4.

Needless to clarify, this Court has not gone into the issue of arrears if any received or to be receivable by the petitioners and the said issue is kept open to be canvassed before the respondent.
