This is an application for condonation of delay in filing an appeal challenging judgment and order of conviction dated 23.10.2020 passed by learned Additional Sessions Judge, Gadchiroli in Sessions Case No.133/2019 whereby learned Judge convicted the applicant for offence punishable under Section 302 of the Indian Penal Code and directed to suffer imprisonment for life. Delay is of 406 days.

Though the application is coming for the first time, the application can be decided today itself.

Heard learned counsel Shri S.G.Joshi appointed for the applicant and learned Additional Public Prosecutor Shri S.S.Doifode for the State.

From the judgment and order of conviction, impugned, it is clear that right from arrest of the applicant he is in jail and is under trial prisoner.

In view of the above, the criminal application is allowed. The delay stands condoned. Office to register the appeal.
