Heard Ms. Sapkal with Shri Kilor, learned counsel for the applicant and Shri S. B. Ahirkar, learned APP for the State/non-applicant no. 1. Though non-applicant no. 2 is served, none appears for non-applicant no. 2.
By the present application, the applicant is seeking condonation of delay of 23 days caused in filing the application for grant of leave to file appeal against the order of acquittal. Learned counsel for the applicant by inviting my attention to the reasons and more particularly, paragraph no. 3 and 4 of the application, submitted that due to wrong advice, the applicant was carrying the wrong impression about the period for filing the proceedings. She further submits that the applicant being Agriculture Produce Market Committee, certain procedural aspects are also to be complied with such as passing of resolution etc. She submits that the delay caused is .....2/-

For the reasons stated in the application and in view of the submissions of learned counsel for the applicant, the delay of 23 days caused in filing the application for grant of leave to file appeal is condoned.
