Having considered the reasons stated in the impugned Judgment and order, I am of the view that this application can be conditionally allowed.
The application is allowed.
The claimant is permitted to withdraw the amount deposited by the appellant in this Court on his furnishing solvent surety and undertaking to the fact that any adverse order being passed against him, he shall refund the amount with such interest as may be directed in that order within four weeks from the date of that order. Application is disposed of accordingly.
