Heard Shri D.M.Dixit, advocate for the applicants and Shri A.D.Sonak, A.P.P. for the non-applicant. The applicants are arrested on 14th September, 2014 in crime registered against them for the offences punishable under Sections 143, 147, 148, 149 and 302 of the Indian Penal Code.
The charge-sheet is filed on 10th December, 2014. The non-applicant has not been able to show that the custody of the applicant is required for further investigation. Considering the facts on record, in my view, the applicants are entitled to be released on bail. Hence, the following order :
i) The applicants, having been arrested in Crime No. 251 of 2014, registered by the non-applicant, they be released on bail on furnishing P.R. Bond for Rs.Twenty Five Thousand each and two solvent sureties in the like amount for each of the applicant.
2 ba62.16 ii) The applicants shall regularly attend the sessions trial on every date unless granted exemption by the Sessions Court.
The application is allowed in the above terms. CRI.APPLN.(APPP) NO. 110/2016.
In view of disposal of the main application, the application for dispensing with affidavit of relative of the applicant and filing of certified copy of F.I.R., does not survive, hence, it is disposed of.
