By this petition, the petitioner challenges the promotion of the respondent no.5 on the post of Junior College Teacher by the order dated 03.05.2012.

Shri Khubalkar, the learned Assistant Government Pleader, raises a preliminary objection to the tenability of the writ petition. It is stated that the petitioner has an alternate efficacious remedy of filing an appeal under Rule 14 of the Maharashtra Zilla Parishad (Discipline and Appeal) Rules, 1964. We uphold the preliminary objection raised on behalf of the respondent nos.1 to 3 and decline to entertain the writ petition.

The writ petition is disposed of with no order as to costs.

The points raised in the petition are kept open. JUDGE JUDGE APTE
