DATED : 24 - 2 -202 At the oral request of learned counsel, Mr. Ingole, leave to amend and to incorporate challenge to the order dated 23-11-2021 (Annexure-B) whereby the Talsildar, Mohadi directed the petitioner to pay royalty and penalty as regards the illegal transportation of sand. 2.

The order which is challenged, is appealable and the petition is dismissed with liberty to avail statutory remedy.

Learned Assistant Government Pleader Mr. K. L. Dharmadhikari points out that in so far as the penalty for illegal use of vehicle is concerned, the same is rightly imposed by the Sub Divisional Officer. I note that the said order is not the subject matter of this petition. 4.

The petition is dismissed with liberty as aforestated.
