Heard learned counsel for the parties.
Nobody appears for respondent no. 2.
Only question is whether the petitioner satisfies the requirement of 13 years experience as per All India Council for Technical Education norms. By the impugned communication dated 7-3-2012, the petitioner found disqualified as she does not satisfy the requirement of experience as per Section 2(34) of the Maharashtra Universities Act, 1994.
It is not in dispute that very same controversy has been decided by this Court in Writ Petition No. 3716/2012 on 17-4-2012. As such, we find that in terms of directions as contained in paragraph no. 12 of that judgment, .....2/-
wp771.15 present writ petition can also be disposed of. Accordingly, the impugned communication dated 7-3-2012 is quashed and set aside.
The respondent no. 1, University to consider the experience of the petitioner and her other academic qualification to find out eligibility for selection and grant of approval. This exercise be completed within a period of two months from today.
The writ petition is thus allowed and disposed of with no order as to costs.
