Upon the parties being sent for mediation in terms of order dated 19.04.2018, the dispute between the parties is settled and compromise terms dated 5.5.2018 were settled between the parties and they have have been placed on record.

The learned counsel for the parties submit that the terms of the compromise have been acted upon including execution of sale deed dated 6.6.2018 executed in favour of the respondent no.3 herein - Hirabai Gaikwad Education Society through its secretary. It is submitted by the learned counsel for the parties that only aspect that now remains is correction of the city survey record by the petitioner in his own name for facilitating its further correction in the name of the respondent no.3-Education Society. The petitioner undertakes to get the city survey record corrected in the aforesaid manner for which the respondent no.3 has already deposited a post dated cheque of Rs.50,000/- in favour of the petitioner. The parties shall abide by the

WP83-18.odt terms of compromise and they shall further cooperate with each other for the only aspect remaining in the dispute between the parties as indicated above. Hence writ petition is disposed of in above terms. Consequently, the order dated 2.1.2018 passed by the Sessions Court, Nagpur is set aside.
