14th December, 2017 This appeal has been filed by the original defendant who is aggrieved by the decree passed by the appellate Court directing him to pay an amount of Rs. 38,793-00 to the plaintiff with interest at the rate of six per cent per annum.
During pendency of the proceedings, an application has been filed by the original plaintiff in which it is stated that the matter has been amicably settled between the parties and the decree has been fully satisfied. The executing Court has passed an order in Regular Darkhast No. 15 of 2015 dated 20th February, 2017, in which it is stated that the decree holder as well as the judgment debtor have filed a joint Pursis that the decree is satisfied.
In view of aforesaid, the Second Appeal is disposed of as having been rendered infructuous. No costs.
