In the present appeal, none appeared for the appellant in the morning session nor on the second call at afternoon session.

Shri H.M. Bobade, the learned counsel appearing for respondent no.1 pointed out that the present appeal along with application for condonation of delay is filed against the order dated 26.8.2019 passed by the learned Member, M.A.C.T. Chandrapur under Section 140 of the Motor Vehicle Act, 1988. He further pointed out that during the pendency of the present proceeding, the main proceeding i.e. M.A.C.P. No.146/2018 pending before M.A.C.T. Chandrapur has been finally decided by the judgment and order dated 19.4.2023. The copy supplied by respondent no.1 is taken on record and marked as 'X' for identification.

In view of above factual position, the present application has become infructuous and, therefore, present application is disposed of as infructuous.
