Taking into consideration the fact that the petitioner was required to be arrested on a number of occasions, and also that on other occasions too, he was in the habit of not returning to the jail after availing the leave, it cannot be said that the authorities have exercised their discretion in an arbitrary manner. In this situation, no interference is called for. Writ Petition No. 151 of 2016 is, therefore, rejected.
Fees payable to the learned Adv. [appointed] for the petitioner are quantified in the sum of Rs. 1500/- [rupees one thousand five hundred only].
