DATE : 21/06/2022 The complaint under Section 138 of the Negotiable Instruments Act, filed by the complainant has been dismissed in default for want of prosecution by the impugned order.

Mr. Deoras, learned counsel for the applicant/ complainant submits that under Exh. 16 dated 8.9.2018 there was settlement between the parties, under the terms of which the accused was to make certain compliances within a period of one year, which were not done and thereafter due to the pandemic appropriate steps to prosecute the complaint could not be taken.

It is not disputed that during the pandemic the proceedings were at a stand still, considering which leave is granted.
