03rd February, 2017 The claimants seek permission to withdraw the amount of compensation deposited by the appellant. The same is opposed by the learned counsel for the appellant.
Perused the impugned judgment. In the facts of the case, the respondent no.1 is permitted to withdraw an amount of Rs.5,00,000-00 [rupees five lakhs only] and respondent no.2 is permitted to withdraw an amount of Rs.1,50,000-00 [rupees one lakh fifty thousand only], subject to each of them filing a separate undertaking that in case the appeal is allowed, the amount withdrawn shall be repaid with interest at such rate the Court may direct. Rest of the amount shall be
invested in fixed deposit.
Civil Application is disposed of.
