Learned Assistant Government Pleader for the respondent makes a statement that the fees of the Arbitrator has been deposited, with the active assistance of the learned Divisional Commissioner, considering which, the proceedings can now go forward. Insofar as the prayer in the civil application is concerned, the same as of date cannot be granted, for the reason that the arbitration proceedings are yet to be decided and any entitlement of the applicant to any amount shall be the result of the award which will be passed.

The civil application is accordingly dismissed. No order as to costs.
