FEBRUARY 9, 2021 Criminal Application (APL) No. 284/2020 was dismissed for want of prosecution as learned advocate for the applicants failed to attend the matter on 17/12/2020 and then on 28/01/2021. Now by this application, the applicants have prayed that the order passed on 28/01/2021 be recalled and the Criminal Application (APL) No. 284/2020 be restored and heard on merits. Though we are not satisfied with the explanation given in the application for the absence, in the interests of justice, the order passed on 28/01/2021 is recalled and the Criminal Application (APL) No. 284/2020 is restored, however, on condition that learned advocate for the applicants shall deposit Rs. Two Thousand with the High Court Legal Services Sub-Committee, Nagpur and produce receipt of it on record till 11/02/2021.

appp180.21 If the amount is deposited, list the Criminal Application (APL) No. 284/2020 for consideration/hearing on 15/02/2021.

If the amount as directed by this order is not deposited till 11/02/2021, the order passed on the Criminal Application (APL) No. 284/2020 shall stand.

The Criminal Application (APPP) No. 180/2021 is disposed accordingly.
