DATE : 7.6.2016 Heard Shri S.D. Abhyankar, advocate for the petitioners, Ms. H.N. Prabhu, A.G.P. for respondent Nos.20 and 21 and Shri P.A. Gode, Advocate for the respondent Nos.2, 4, 7, 13, 14 and 17. None appears for the other respondents.

The petitioners have challenged the interim order passed by the learned Joint Charity Commissioner refusing to stay the effect and operation of the order passed by the Assistant Charity Commissioner on 19th September, 2013 by which the Assistant Charity Commissioner has appointed first board of trustees. On query, the learned Advocate for the petitioners has stated that hearing of the appeal is in progress. Considering the facts of the case and as there is no interim order in this petition

2 wp2565.14 since last two years and as the appeal is being heard by the learned Charity Commissioner, I am not inclined to consider this petition on merits.

The petition is disposed with direction to the learned Joint Charity Commissioner to dispose the appeal till 30th September, 2016.
