This application is filed for restoration of the first appeal.

The appeal was dismissed for non-filing of paper-book within stipulated period.

As per contention of applicants, she could not notice the conditional order and, therefore, paper-book was not filed. Now, the paper-book is ready and she will file the same within a week. 4.

The said application is opposed by learned Assistant Government Pleader Ms T.H.Udeshi for non-applicant Nos.1 and 2 on the ground that the conditional order was not complied with and, therefore, she prays that the application be rejected. 5.

For reasons stated in the application, the application is allowed. The first appeal is restored to its original file, however the same shall be subject to filing of paper-book within a week and copy of the same be furnished to other side.

The Misc. Civil Application is disposed of.
