The petitioner challenges the communication dated 09.09.2010 by which approval to the appointment of the petitioner has been refused. Shri R. A. Gupte, learned counsel appearing for respondent no. 4 submits that during the pendency of the writ petition the services of the petitioner have been terminated on 06.02.2015. It is also submitted that the petitioner has challenged the order of termination by filing an appeal under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Services) Regulation Act 1977.

In view of aforesaid it would be open for the petitioner to raise a challenge to the order refusing approval to her appointment in the appeal filed by her. The said aspect can be considered in appeal that is pending before the School Tribunal. The points in that regard raised in the writ petition are kept open. Petition is disposed of with no order as to costs.
