Mr. Renu, learned counsel the applicant submits that he wishes to withdraw the present application in order to file revision before the learned revisional Court. He submits that the interim order granted by this Court on 11.02.2015 may be continued.

The prayer for permission to withdraw the application is granted with liberty to the applicant to approach the revisional Court challenging the order passed by 19th Judicial Magistrate First Class & Special Court for 138 of the Negotiable Instruments Act, Nagpur dated 13.01.2015 in Summary Criminal Case No.7244/2005. The learned counsel for the applicant states that he will file revision application within four weeks from today. The statement is accepted.

If the revision is filed within four weeks from today and if the revision application is accompanied with an application for condonation of delay, it is expected from the learned revisional Court to consider the said application sympathetically in view of the pendency of the present application under Section 482 of the Cr.P.C. before this Court, by applying the provisions of the Limitation Act. The interim order dated 11.02.2015 shall remain in force for seven weeks from today. After lapse of seven weeks, the interim order shall cease to operate.
