As recorded in the order passed in the morning session, we started the final hearing of the appeal. After the appeal was heard for sometime, the learned Advocate for the respondent-accused on instructions from the accused who is present in the Court submitted that the respondent-accused will not make any claim for reinstatement in service with the Oriental Insurance Company Limited till the decision of this appeal. It is assured that an affidavit to that effect shall be placed on record by tomorrow i.e. 03.02.2021. He further stated that the appeal can be heard in due course as per its chronology.

The appeal be listed for final hearing in due course as per chronology.

Criminal Application (APPA) No.76/2021.

By order dated 08.01.2021, while admitting the appeal, it was directed that action be taken against the respondent-accused under Section 390 of the Code of Criminal Procedure. The accused came to be arrested on 01.02.2021 and as the learned Assistant Sessions Judge had not considered the prayer of the respondent-accused for his release on bail, he was kept in custody. Today, the respondent-accused is produced. It is directed that the appeal filed by the appellant - Central Bureau of Investigation shall be heard in due course.

In the above facts, following order is passed. i.

The respondent-accused - Ravishankar Bhaskar Londhekar be released forthwith on executing P.R. bond for Rs.50,000/- (Rs. Fifty Thousand Only) and furnishing one solvent surety for Rs.20,000/- (Rs. Twenty Thousand Only). The respondent-accused is granted 15 days' time to execute the P.R. bond and furnish solvent surety. ii.

The respondent-accused shall appear before the learned Adhoc District Judge-1 and Assistant Sessions Judge, Nagpur and complete the formalities.

iii.

The respondent- accused shall complete the formalities by 16.02.2021, failing which the learned Adhoc

District Judge-1 and Assistant Sessions Judge, Nagpur shall pass appropriate order against him as per law. JUDGE JUDGE RGurnule
