Heard the learned Counsels appearing for the parties.

Looking to the enhancement granted by the Reference Court and the dispute regarding existence of trees, the claimant can be permitted to withdraw 50% of the amount deposited by the appellant upon furnishing solvent security to the satisfaction of the Registrar (Judicial) of this Court.

Hence, the civil application is allowed. The appellant is permitted to withdraw 50% of the amount deposited by the appellant upon furnishing solvent security to the satisfaction of the Registrar (Judicial). The balance amount to be invested in the fixed deposit in any nationalized bank initially for a period three years and subsequently to be renewed, if occasion arises.
