The applicant is apprehending arrest in Crime 01/2021 registered with Police Station Pipalgaon Raja, Tah. Khamgaon, District Buldhana for offences punishable under Sections 306, 294 read with Section 34 of the Indian Penal Code.

The allegation is that the applicant entered the house of Mrs. 'M'. He was followed by his wife, who indulged in character assassination of Mrs. 'M', who could not bear the humiliation and therefore, consumed poison. 3.

Considering the nature of the accusations, there is sufficient scope to argue, as is done by the learned counsel Mr. M.N. Ali, that the material on record does not prima facie suggest that there was instigation to commit suicide.

The interim protection granted vide order dated 05.02.2021 is made absolute with the only modification that till the charge-sheet is filed, the applicant shall attend the concerned police station as and when required by the Investigating Officer.
