Heard. By the present writ petition the petitioner prays that he be granted promotional pay scale on the post of Junior Engineer from the date he has completed 12 years of service or at least with effect from 01.10.1994 with other consequential benefits. The petitioner was appointed as Tracer on 08.05.1981 and was promoted on the post of Assistant Draftsman on 16.08.1995. According to the petitioner as other similarly situated colleague who was promoted on 11.07.1985 was granted benefit of promotional pay scale on 11.07.1997, he was also entitled for the same. Relief of seeking promotional pay scale is sought on the basis of completion of 12 years of service. However, as the petitioner was already promoted once in the year 1995, Shri P. D. Meghe, learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to file appropriate writ petition so as to resolve the anomaly in the

1201wp926.15 pay scale in which he is presently placed.

The writ petition is therefore permitted to be withdrawn with aforesaid liberty. Points raised in the petition are kept open. Order accordingly. No costs. JUDGE JUDGE svk
