Heard Ms Archana Ramteke, learned counsel for the applicant/respondent No.1 and Mrs S.P. Deshpande, learned counsel for the appellant.

Perused the application as well as impugned judgment and award. From perusal of the impugned judgment and award, I am of the view that 50% amount of compensation could be permitted to be withdrawn by the applicant/respondent No.1 on usual undertaking.

Hence, I pass following order :-

ORDER

The applicant/respondent No.1 is permitted to withdraw 50% of the amount of compensation deposited by the

9caf2760.18.odt 2 appellant in this Court on furnishing usual undertaking to the effect that in case appeal is allowed she will refund the amount to the appellant and remaining amount be kept in fixed deposit till the disposal of the appeal.

Civil application is allowed.
