Petitioner is seeking quashing of prosecution launched vide Proforma at Annexure-I with the petition. There is also interim prayer for staying it. This Court has while issuing Rule in the matter on 17.03.2005 granted interim relief accordingly.

We have perused Annexure-I. That annexure points out to the petitioner that there is prima facie contravention of Section/Rule 39 read with 3rd Schedule, which is punishable under Rule 39

Order 2704wp635.05 of the Standards of Weight and Measures Act, 1976 and Rules framed thereunder.

In this situation, the matter needs to be registered as Criminal Writ Petition and listed before appropriate Bench. Office to verify and act accordingly.
