The petitioner has called in question the impugned communication dated 16.01.2024 requiring petitioner to deposit some of Rs. 16,48,000/- by resorting the provisions of Section 91 of the Code of Criminal Procedure ("Code"). 3.

Two similar notices have been called in question relating to the same offence in Criminal Writ Petition Nos. 99/2024 and 101/2024. In those petitions, this Court has clearly expressed that the impugned communication does not sustain in law as Section 91 of the Code does not empower the Police to direct to deposit sum.

In view of above, impugned communication dated 16.04.2024 is hereby quashed and set aside.
