Mr. Bhoyar, learned counsel appears for the applicant. None present for the non-applicant though served.

The application seeks the transfer of the Hindu Marriage Petition No.26/2019 from the file of Civil Judge Senior Division, Umred, to that of the Civil Judge Senior Division, Wardha, on the ground that proceedings initiated by the wife, under the provisions of Section 125 of the Code of Criminal Procedure are already pending before the Judicial Magistrate First Class, Wardha. Since the wife is residing within the territorial jurisdiction of the Judicial Magistrate First Class, Wardha and since this Court by an order dated 4.2.2020 has already stayed the proceedings in Hindu Marriage Petition No.26/2019, pending before the Civil Judge Senior Division, Umred, it would be appropriate in the interest of the parties to expeditiously transfer Hindu

(2) 32.mca.88.2020 Marriage Petition No.26/2019 from the file of Civil Judge Senior Division, Umred to the file of the Civil Judge Senior Division, Wardha.

The application is accordingly allowed, in the above terms. No costs.
